Preserving Evidence

When you've been injured by someone else's carelessness, it's important to take steps to preserve evidence and document your claim.

  • Obtain reasonable and necessary medical care from reputable sources. Be thorough and accurate in describing your injuries to health care providers. Remember the old adage: “if an injury is not documented in the medical chart it did not happen.”
  • Be wary of ambulance chasing doctors whose representatives call you up after an accident. Rely upon referrals from your family physician, friends, coworkers and family.
  • Write down what you remember about how the injury occurred, including the names, addresses and phone numbers of potential witnesses, police and insurance company representatives.
  • Be very careful about making any statements, written or verbal, to insurance company adjusters or representatives. If you are uncomfortable speaking with insurance representatives call our office for a free consultation.
  • Do not sign anything you do not fully understand.
  • Protect and preserve evidence you may need to prove your claim. Take pictures of any accident vehicles, the accident scene, clothing you were wearing, damaged personal belongings, and so forth.
